TERMS OF AGREEMENT FOR THE PURCHASE OF ARIZONA GEEKS COMPUTERS, COMPUTER PARTS, TECH SUPPORT, AND SALES AFFILIATES.

Arizona Geeks is a LLC corporation located in Mesa Arizona.  We sell computers, computer parts, and perform tech support services.  All sales take place thru the internet.  The mailing address is 2753 E Broadway Rd Suite 101-109 Mesa AZ 85204.

This document is binding and covers computer sales, computer parts, sales affiliates, and tech support services from Arizona Geeks.  Anyone who purchases a computer, computer parts, tech support services from Arizona Geeks or sales affiliate agrees to the terms of this document.  This document is subject to change and may change at anytime.  This document can be viewed online at the address of www.arizonageeks.com/terms/.  Any changes to this document will be announced in the Arizona Geeks Computer Forum.  The address of that forum is http://arizonageeks.com/computerforum/index.php.  An email will be sent to all members of the forum.  There is no charge to visit the forum site or become a member of the forum.  It is highly recommended that anyone who purchases computers, computer parts, or tech support from Arizona Geeks becomes a member of the forum.

EMAIL

Arizona Geeks may send newsletter emails to members of the Arizona Geeks Computer Forum.  This includes customers and sales affiliates.  We try to keep these at a minimum.  The forum will always be the primary way for us to communicate with customers and sales affiliates.

COMPUTER SALES

1.1  Arizona Geeks manufactures personal computers (PC's) with Windows operating systems.  The operating systems used are XP Pro, Vista, and Windows 7.  The desktop systems sold include the tower, mouse, and keyboard.  There may be some systems sold that only include the desktop tower.  Desktop computers are shipped to addresses in the USA thru well known carriers like UPS, FedEx, and the United States Postal Service.  All computers are shipped with insurance.  Arizona Geeks sells and ships computers to all 50 states of the USA. 

1.2  Warranties:  All Arizona Geeks desktop computers come with a one year parts and labor warranty.  Most software issues can be fixed by remote computer access or instructions over the phone.   Hardware replacement of any parts may require the customer to ship the computer back to Arizona Geeks at the address listed above at customer expense.  Customer will pay for round trip shipping and may select normal shipping or overnight shipping at their option.  It is highly recommended that customer includes shipping insurance.  Arizona Geeks is not responsible for any damage or loss that may occur during shipping.

1.3  Remote computer access done thru the gotoassist program will be used to help solve any software or hardware issues.  This may require customer participation to solve these issues.  Most customer participation is usually minimal and may include describing the nature of an issue, placing a cd or dvd in the desktop tower, checking physical wiring connections, reseating memory, reseating hard drive cables, or the replacement of a motherboard battery.  Other situations may involve different levels of customer participation.

1.4  If the customer is unable to participate in the problem solving of issues they may designate another individual of their choosing to assist.  If customer is unable to properly assist or refuses to assist this will void all warranties.

1.5  Customer agrees that all computers are for private home use or business use.  Customer agrees not to use Arizona Geeks computers or its individual parts for any kind of military usage, explosives, or terrorist activities.  Customer agrees that they will not ship Arizona Geeks computers to any other country.  The only exception to this is if a customer is moving to another country.  

1.6  It is a top priority for Arizona Geeks to do everything possible to make sure the customer has a solid, reliable computer.  Every reasonable effort will be made to achieve this goal.  Customers who are rude or threatening in any way will void their warranty and be refused further assistance from Arizona Geeks.  Any threatening actions may be reported to law enforcement agencies for possible prosecution.

1.7  Uninterrupted Power Supplies (UPS):  An uninterrupted power supply is a highly recommended piece of equipment and should be used as it will help the reliability and performance of Arizona Geeks computers.  A UPS offers superior power surge protection which is much more effective than a power strip.  Power strips offer very limited if any protection from electrical power spikes.  The APC company manufactures them.  Their web site is www.apc.com.  They are available at many different local retailers and are also available from Arizona Geeks.  If customer lives in an area where there are thunderstorms and possible power outages a UPS should be used.  Failure to use a UPS may void the warranty.  Arizona Geeks is not responsible for any damage due to power surges, thunderstorms, lightning, power failure, wind damage, flying debris, floods, earthquakes, or any other natural disasters.  

1.8  Limitation of damages:  Arizona Geeks is not liable for any damages due to loss of use of computer purchased by customer.  Arizona Geeks is only liable to return the computer to the original state it was in when it was new.  This means fully working hardware and a functional Windows operating system.  This does not include any programs or files customer may have added.  Arizona Geeks is not responsible for any damage to computer caused by accidents, children, pets, theft, loss, or malicious activity.  

1.9  Data integrity:  Customer is 100% responsible for their data.  This includes any and all files stored on the hard drive(s) or other digital storage devices.  It is highly recommended that customers backup or copy their data to additional hard drives or backup media such as cd's, dvd's, or flash drives.  Customers may pay for tech support training from Arizona Geeks to learn how to backup their data.

1.10  Media:  Computers from Arizona Geeks ship with the Windows operating system disk and a disk which contains device drivers.  It is the customers responsibility to properly store these disks in a safe location.  They may be needed to reinstall Windows at a later date.  Customer is 100% responsible for the safe storage and future accessibility of these disks.  Loss of these disks may require the customer to purchase a new Windows operating system disk.

1.11  Acts of war:  Arizona Geeks is not responsible for any damage to computers caused by acts of war, riots, or civil unrest.

1.12  Ccleaner:  Arizona Geeks uses this program to help troubleshoot computer problems and perform normal maintenance.  Arizona Geeks is not responsible for any possible conflicts or loss of data this program may cause with other customer installed programs.

1.13  Custom programs:  Arizona Geeks does not support custom programs installed by the customer.  Custom programs may interfere with the Windows operating system and cause conflicts.  Custom programs may void the warranty.

1.14  Customer installed programs: Customer assumes all risk when installing any computer program.  It is highly recommended that customers do not use the following programs.  Toolbars of any kind, limewire, bit torrent, Norton anti virus, MacAfee anti virus, AOL software, EarthLink software, NetZero software, and file sharing sites such as rapidshare and megaupload.  Customers should also use extreme caution before using trial software or shareware on their computer.  Customer usage of these programs and web sites may void the warranty.  

1.15  Internet:  It is assumed that most customers will be using the internet with their computer.  Accessing the internet may expose the customer to such things as computer viruses, spyware, malware, scareware, hacking attempts, root kits, key loggers, and other possible risks.  Arizona Geeks computers include a multi layered security suite to help prevent these things from happening.  Arizona Geeks is not responsible for any damage caused by internet threats.  Arizona Geeks will offer tech support services to help solve problems caused by computer viruses, spyware, malware, scareware, hacking attempts, root kits, and key loggers for a fee.  Arizona Geeks is not liable for a customers Internet Service Provider (ISP), networking equipment, or the reliability of the internet or ISP.

1.16  Litigation:  You agree to hold Arizona Geeks harmless in all matters.  Any litigation must take place in Maricopa County Arizona.

1.17  Email:  Email is the preferred method of contact for Arizona Geeks.  Our main email addresses are: john@arizonageeks.com (owner), sales@arizonageeks.com, support@arizonageeks.com, and affiliates@arizonageeks.com

1.18  Sales Affiliates:  Arizona Geeks does have relationships with independent commissioned sales agents.  These agents refer business to Arizona Geeks for a fee.  These sales affiliates are not employees and Arizona Geeks is not responsible for any technology inaccuracies, pricing inaccuracies, or any other actions on the part of sales affiliates.

1.19  Computer maintenance:  It is the customers responsibility to properly maintain their Arizona Geeks computer.  If the customer is unable to properly maintain their computer they may have Arizona Geeks perform maintenance procedures for them for a fee.  It is highly recommend that customers perform maintenance on their computer in an appropriate time frame in relationship to their computer usage patterns.  Arizona Geeks will work with the customer and help determine proper maintenance procedures and time frames based on customer computer usage patterns.  Failure to perform regular maintenance may cause a variety of conflicts, data loss, and even system failure.  It is to the customers advantage to perform proper maintenance on a regular schedule to improve computer performance and enhance customer experience.

1.20  Hardware firewalls:  Hardware firewalls are highly recommended.  They help prevent hackers from accessing a customers computer.  Arizona Geeks sells hardware firewalls and will help install them.  Software firewalls like zone alarm are not nearly as effective.  Not using a hardware firewall may void your warranty.  

1.21  PayPal:  Arizona Geeks uses PayPal to collect payment from it's customers.  Customers may use credit cards, debit cards, processed by PayPal or money orders from the United States Postal Service to pay for computers, computer parts, or tech support services.

1:22  Privacy:  Arizona Geeks respects the privacy of their customers.  We never sell or give any information to outside entities.  In the course of doing normal business in regards to setting up a customers computer or performing tech support services it may be necessary for employees or agents of Arizona Geeks to gain access to password protected areas on the computer or on web sites.  This is very serious and important to Arizona Geeks and utmost care is taken in regards to the protection of passwords.

COMPUTER PARTS

Customers may purchase computer parts thru Arizona Geeks.  All parts include the manufacturers warranties available at the time of purchase.  Customers may pay Arizona Geeks to clone all data from an old hard drive to a new or larger hard drive.  Customers must pay for round trip shipping of hard drives, desktop towers, or notebook computers for part(s) replacement.  It is highly recommended that customers include insurance on all shipments to Arizona Geeks.  Customers will be charged for parts and or labor.  Customers need to contact Arizona Geeks first before shipping anything to Arizona Geeks.  Any shipments that don't have prior approval will be refused.  Customers who are rude or threatening in any way will be refused further assistance from Arizona Geeks.  Any threatening actions may be reported to law enforcement agencies for possible prosecution.

You agree to hold Arizona Geeks harmless in all matters.  Any litigation must take place in Maricopa County Arizona.

TECH SUPPORT

Arizona Geeks provides Windows tech support services.  We provide tech support for XP, Vista, and Windows 7 operating systems.  All tech support services are performed in the USA and in English.

1.1  Best Effort:  All tech support services are done on a best effort basis.  Most of the time positive results will occur.  There are times when because of customer equipment configurations and performance goals a positive outcome is not as likely.  Customers in this situation will be told of this in advance and proper outcome expectations will be announced before any tech support service occurs.  Customer may exercise the option to have tech support services performed but fully understand positive results may or may not happen.  Customers who are rude or threatening in any way will be refused further assistance from Arizona Geeks.  Any threatening actions may be reported to law enforcement agencies for possible prosecution.

1.2  Refunds for tech support:  There are no refunds for tech support services performed on non Arizona Geeks computers.  There may or may not be refunds for tech support done on Arizona Geeks computers that do not achieve positive results.  This is up to the sole discretion of the management of Arizona Geeks.

1.3  Guarantees:  There are no guarantees for tech support services.  In many cases the original problem the customer discusses with tech support is not the true cause of the computer problem.  Only after performing a thorough examination of the customers computer the root cause of the problem may be determined.  This examination of the customers computer will not be performed without being paid first.  It is possible that customer usage patterns, system configurations, software, hardware, system design, or mistakes made by the customer may cause the same problem or other problems to return or occur at a later date.  These are just some of many factors outside of the control of Arizona Geeks tech support.  Arizona Geeks is not liable for any damage done to a customers computer while performing tech support services.

1.4  GoToAssist:  Arizona Geeks uses this internet based program to remotely access customers computer in order to perform tech support services.  If a customer does not have reliable internet access it may not be possible to perform tech support services.  It's possible that Arizona Geeks tech support might have two or more tech support sessions happening at the same time.  Our remote access technology allows for this.

1.5  Payment:  Customers must pay upfront for tech support services before they are performed.  Current tech support rate information is always on the main page at www.arizonageeks.com.  We use PayPal to accept credit card and debit card payments.  Money orders from the United States Postal Service are also accepted but may delay the performance of tech support services.

1.6  Priority:  Customers who have purchased computers from Arizona Geeks will always be the top tech support priority.  They will always go to the front of the line for tech support services.  Customers with non Arizona Geeks computers will be served on a first come first served basis.

1.7  In some situations such as replacing a hard drive or other hardware component, an Arizona Geeks tech support customer may send their computer to Arizona Geeks for service.  Customers are responsible for the round trip shipping of their computer and should include shipping insurance.  Arizona Geeks is not responsible for any damages that occur during shipping.  All computers sent to Arizona Geeks must have prior approval or they will be refused.

1.8  Forum:  All tech support customers are encouraged to visit and join the Arizona Geeks Computer Forum.  The address of that forum is http://arizonageeks.com/computerforum/index.php.  It is free and customers can ask basic tech support questions there.  This is a great way to stay in touch with Arizona Geeks.

1.9  Data integrity:  Arizona Geeks tech support customers are 100% responsible for all data on their hard drives or other storage devices.  Arizona Geeks is not liable for any data loss while performing tech support services.

1.10  Wireless Issues:  Arizona Geeks does not offer tech support services for wireless issues.

1.11  Adult content:  Arizona Geeks will perform tech support services on computers with adult content.  Arizona Geeks believes in free speech and freedom of choice.  Any computer that has illegal adult content on it will be reported to law enforcement.  

1.12  Customers outside of the USA:  Because of the remote access capability of Arizona Geeks tech support, it is possible for us to service customers anywhere in the world.  Tech support customers outside the USA that have a credit card or debit card may use our tech support services.  We are able to do online chat with customers while performing tech support services.

1.13  Communication:  Depending upon the situation, Arizona Geeks may use telephone or online chat to assist tech support customers.  

1.14  Sales Affiliates:  Arizona Geeks does have relationships with independent commissioned sales agents.  These agents refer business to Arizona Geeks for a fee.  These sales affiliates are not employees and Arizona Geeks is not responsible for any technology inaccuracies, pricing inaccuracies, or any other actions on the part of sales affiliates.

AFFILIATES

1.1  Requirements:  You must be at least 18 years of age.  You must be a legal resident of the United States of America.  Sales experience is helpful but not mandatory.  Send us an email to affiliates@arizonageeks.com with your name, address, phone number, and email address.  You must have a business appropriate email address.  We will review your application and approve or reject it.  Just about anyone may become a sales affiliate of Arizona Geeks.  If you can find people or businesses that want our computers or tech support services we want you as an affiliate.

1.2  Job description:  You are an independent sales affiliate for Arizona Geeks.  You will be selling computers and tech support services for Arizona Geeks.  This is a commissioned independent contractor position with no benefits.  You may set your own hours and work part time or full time.  

1.3  Payment for sales:  The current pay rate for sales is located at www.arizonageeks.com/affiliates/.  You only get paid when you make a sale.  Contractors are not allowed to accept any payments.  Approved retail locations may accept payments.  All customer payments must be made thru the Arizona Geeks web site which is www.arizonageeks.com.  Customers may use credit cards, debit cards, or money orders from the United States Postal Service.  Money orders will take longer to process and may cause some delays.

1.4  Taxes:  Because this is an independent contractor position no taxes are taken out of your commission checks.  You are responsible for all taxes on money you earn from Arizona Geeks.  If you make over $600 in a calendar year, you must furnish a valid social security number or federal tax ID number.  Failure to provide a tax ID will result in forfeiture of commissions.  You will be notified when you are getting close to the $600 threshold.  

1.5  Sales quotas:  There are no sales quotas.  It is fine to sell three computers or tech support services a year, or three computers or tech support services an hour.

1.6  Pay periods:  There are two pay periods a month.  The first runs from the 1st to the 15th of the month.  The second runs from the 16th to the end of the month.  Checks are sent out the week after the pay period ends.  You will not get a check if you do not have any sales for that period.

1.7  How you get paid:  When you are talking to a potential customer and they are interested in purchasing an Arizona Geeks computer or tech support services you want to give the customer a business card or flyer with your email address on it.  This is how Arizona Geeks tracks your sales.  Tell the customer that we will be asking for your email address then have the customer contact Arizona Geeks by email or telephone to complete the computer or tech support sale.

1.8  Credit for all sales:  You will get paid for all sales even if you buy a computer or tech support services for yourself or your own company.  

1.9  Forum:  After your application is approved please go to the Arizona Geeks Computer Forum and register.  The address of that forum is http://arizonageeks.com/computerforum/index.php.  It's free and this is how we get information out to our customers and affiliates.  Be part of our community!

1.9  Expenses:  Expenses are low and include things like business cards, flyers, and mileage.  Consult with a tax advisor but many of your expenses should be tax deductible.  Purchasing a computer from us may also have tax advantages.

1.10  Franchise fee:  There are no franchise fees.  We want you to start making money right away and not have to worry about the debt of a franchise fee. 

1.11  Multi level marketing:  This is not multi level marketing in any way.  You will always have a one on one relationship with Arizona Geeks.

1.12  Code of conduct:  Sales affiliates are required to present and conduct themselves in a professional manner at all times.  You should refrain from using any profanity and always wear proper business attire.  If we receive complaints, you may lose your affiliate status.  If any illegal activity occurs you will lose your affiliate status immediately and forfeit all current commissions.  Affiliates who are rude or threatening in any way will lose their affiliate status from Arizona Geeks.  Any threatening actions may be reported to law enforcement agencies for possible prosecution.

1.13  Leads:  There are no sales leads.  Each affiliate is on their own to find sales leads.  You may be creative as long as your are professional to generate sales in various ways.  You can buy an Arizona Geeks computer and use it for demo purposes for groups.  This can be very effective.  You may not spam, make cold calls, or do anything else that may violate your local regulations or annoy the public in general.  You may not advertise on backpage.com or craigslist.com.

1.14  Retail locations:  Retailers interested in selling Arizona Geeks computers may have a working system on display in their retail location.  You may also put small flyers in the bags of customers.  Make sure your flyers have your email address on them.  Getting the word out is the key.

1.15  Litigation:  You agree to hold Arizona Geeks harmless in all matters.  Any litigation must take place in Maricopa County Arizona.
